Numerous privacy and data protection laws provide for a private right of action – such as the Biometric Information Privacy Act (BIPA), Video Privacy Protection Act (VPPA), the Telephone Consumer Privacy Act (TCPA), and even the Uniform Trade Secret Act (UTSA). This session will discuss whether recent rulings in these cases encourage “troll” behavior, and will consider how statutory and case law should evolve so that individuals are afforded the ability to sue to protect their rights, but corporations are protected from burdensome settlement-driven litigation threats.
