In the past few years, state and federal regulators have been shining a spotlight on data brokers. At the federal level we have seen regulation on bulk data transfers under the Protecting Americans’ Data from Foreign Adversaries Act, the February Executive Order on Executive Order on Preventing Access to Americans’ Bulk Sensitive Personal Data and United States Government-Related Data by Countries of Concern, and the CFPB’s March 2023 request for information about data brokers. States have been regulating data brokers through the establishment of data broker registries and often include mandates on security protocols, public disclosures, and consumer rights. Recently, California has updated its data broker requirements to comport with the CCPA while Texas and Oregon passed laws in 2023.
This session will focus on key federal and state regulation of data brokers, limits on international data transfers, and related developments. It will also discuss regulatory trends, enforcement priorities and compliance considerations for navigating the current regulatory environment.
