This session will explore administrative and judicial interpretations and enforcement actions, including those of the Federal Trade Commission and the Office for Civil Rights of the Department of Health and Human Services, related to the sharing of data collected through online tracking technologies. We will discuss, among other things, the June 2024 federal district court opinion in American Hospital Association, et al. v. Becerra regarding what types of online tracking data constitute “individually identifiable health information” under HIPAA, and explore how that decision and others may influence future interpretations of similar privacy law terms.
