Heightened FTC, state AG, and international regulatory expectations around transparency create significant privacy enforcement risks for companies. User-facing interfaces and policies must be each and all of the following: accurate, complete, and fully implemented. Aligning product functions and features to these evolving transparency and disclosure requires a strong alliance of advanced legal and technical skills and operational controls.

This panel will discuss best practices and challenges for assuring that public statements and privacy notices accurately reflect technical data flows, including how to structure meaningful privacy controls, how to conduct investigations of back-end systems, the advantages of privacy by design and the potential role of internal audit. The panel will also discuss how to mount technical defenses against enforcement actions challenging transparency, and how to help companies tackle the process of improving legacy logging, monitoring, enforcement and deletion processes that might be misaligned.
